Introduction

Thank you for your interest in HealthGuys Services referred to in this document as HealthGuys, we, or us. This term of use document covers the company as well as our other websites where we post this document as the applicable terms of use, along with any related websites, networks, applications, as well as insurance agent and representative services. It also pertains to communication channels including online chat and telephone call centers. These Terms of Use are a legally binding contract between you and HealthGuys regarding your use of the Service.

PLEASE READ THE FOLLOWING TERMS CAREFULLY. By clicking any button on the site to submit your information or by otherwise using the site services, you agree that you have read and agreed to be bound by the terms and conditions as well as the HealthGuys Privacy Policy.

You also agree that HealthGuys or any owned entities may (1) call and text you regarding our services, and (2) monitor and record any telephone calls made or received by us for HealthGuys business purposes.

Services Overview

HealthGuys and entities provides a service where consumers and businesses can research and shop for various insurance and related products. HealthGuys and entities are not an insurance company.

Eligibility

You must be at least 18 years of age to use the services provided by this company. By agreeing to these Terms, you represent that you are at least 18 years of age and your use of the services follow all applicable laws and regulations. If you are using the services on behalf of an entity, organization, or company, you represent that you have the authorization to bind that organization to these Terms and conditions and you agree to be bound by these Terms and conditions individually as well as on behalf of the organization you are representing.

Electronic Communications

By providing us with a telephone number and other contact information when requesting contact, you agree to receive communications, including email, text, and calls. These correspondences may come from or on behalf of Health Reform Team, its affiliates, employees, contractors, agents, business partners or other third parties permitted to receive your information under the company’s Privacy Policy at the email address or phone number you provide. This applies even if the phone number is on a National or State Do Not Call List. These calls may be for information and marketing purposes. It is not required that you provide your consent to these calls as a condition of a purchase on or through our company. Furthermore, you may revoke any consent for marketing messages, phone calls or text messages as described below. HealthGuys may, without further notice and at our discretion, monitor and record phone conversations for business purposes, such as for training purposes.

Prohibited Conduct

By using our services, you agree that you will NOT:

• use the services for illegal purposes or in violation of local, state, national, or international law.
• violate, or encourage others to violate, the rights of a third party.
• interfere with security-related features of the services, including disabling or circumventing features that prevent or limit use or copying of any content
• attempt to reverse engineering or otherwise attempting to discover the source code of any portion of the services except to the extent that the activity is expressly permitted by applicable law.
• perform any fraudulent activity including impersonating a person or entity, claiming a false affiliation, or falsifying your age or date of birth.
• use data mining, robots, or other data gathering devices on or through the services.

Third-Party Services

HealthGuys or entities may provide tools through the services that enable you to export information to third party services. By using any of these tools, you agree that we may transfer that information to the applicable third-party. We are not responsible for any third-party service’s use of your exported information.

Termination of Use; Discontinuation and Modification of the Service

You may terminate your account at any time by discontinuing your use of our services, cancelling your policy, or opting out of receiving communications. If you violate any provision of these Terms, your permission from us to use the services will terminate automatically. We also reserve the right to modify or discontinue the services at any time, temporarily or permanently, without notice to you if a violation occurs. You agree we will have no liability due of any change to the services or any suspension or termination of your access to or use of the services.

Privacy Policy; Additional Terms

Read the HealthGuys Privacy Policycarefully for information relating to our collection, use, storage and disclosure of your personal information. The HealthGuys Privacy Policy is incorporated and made a part of these terms and conditions.

Additional Terms Your use of the services is subject to all additional terms, policies, rules, or guidelines applicable to the service that we may post on or link to. All Additional Terms are incorporated by this reference into, and made a part of, these Terms.

Modification of these Terms

HealthGuys and entities reserves the right to change these Terms at any time for any reason. Checking the Terms periodically for changes is advised. Any use of the services after the Terms are modified constitutes your acceptance of the modified Terms. Disputes that come up under these Terms will be resolved in accordance with the version of the Terms that was in effect at the time the issue arose.

Ownership; Proprietary Rights

The services are owned by HealthGuys. This ownership includes visual interfaces, graphics, design, compilation, information, data, computer code including source code, products, software, services, and all other elements of the services. These are referred to as materials and are provided by HealthGuys. These materials are protected by intellectual property and other laws. All Materials are the property of HealthGuys or our third-party licensors. Except as authorized and intended by us, you may not use the Materials. HealthGuys reserves all rights to the Materials.

Indemnity

You are responsible for your use of the services to the extent permitted by law. You indemnify HealthGuys and entities including its employees, consultants, affiliates, agents, business partners and other third parties permitted to receive your information under our Privacy Policy from and against all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with: your access to, use of, or alleged use of, the services; your violation of any portion of these Terms, or any applicable law or regulation; your violation of any third-party right; or any dispute or issue between you and any third party. We reserve the right, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and, you agree to cooperate with our defense of said claim.

Disclaimers; No Warranties

ALL services, materials, and content are provided “AS IS” on an “AS AVAILABLE” basis, without warranty of any sort. HealthGuys and any entity disclaim all warranties expressed or implied, relating to services, materials, and/or content and arising through the course of conducting business to the fullest extent of the law. Further, HealthGuys and entities do not warrant that the services or any portion therein will go uninterrupted, be secure, free of errors or harmful components, and do not warrant that any of these issues can or will be corrected.

Absolutely no advice or information obtained orally or in writing and obtained in any manner available through the services or otherwise will create or constitute a Warranty regarding Health Reform Team or entities unless expressed Explicitly in these Terms. You assume all risks of damage that may result in use or access of the services, content, and/or materials to the fullest extent of the law. You agree that you use, access, download or otherwise obtain materials, content, and information involving the services, at your own discretion and risk. You agree that, to the fullest extent of the law, you are solely responsible for any damage to your property, or the loss of data that results from use of our services, content, or materials.

Limitation of Liability

There is no event where HealthGuys or entities will be liable to you for any direct, indirect, incidental, consequential, or punitive damages relating to or arising from access/lack of access or use of our services, materials, or content. To the fullest extent of the law, this applies whether based on warranty, contract, tort, statute, or any other legal theory, and whether HealthGuys is informed or not.

Not Advice

The Materials are for informational purposes only. No Material is intended to be a substitute for professional medical advice, diagnosis, or treatment. You should always seek the advice of your physician or other qualified health provider with any questions you have regarding any medical condition. HealthGuys and any entity does not recommend or endorse any tests, physicians, products, procedures, opinions, insurance coverage or other information that may be mentioned on the services. Reliance on any information provided by us, our employees, or other visitors to the services are at your own risk.

General

These Terms, coupled with the Privacy Policy and any other agreements, are the entire and exclusive agreement between you and HealthGuys regarding your use of our services. You may not assign or transfer these Terms or your rights under these Terms, in any way, without our prior written consent. If any part of these Terms is held to be invalid or unenforceable, the unenforceable part will be given effect to the fullest extent permitted by law, and the remaining parts will remain in full force and effect. Upon termination of these Terms, along with the Privacy Policy and any other accompanying agreements, will remain in effect.

By using the Service, you consent to receiving certain electronic communications from us as further described in our Privacy Policy. You agree that any notices, agreements, disclosures, or other communications we send to you electronically satisfy any legal communication requirements, including those communications in writing of any form.
